A Message from the Founder


Dear Colleague,

I, like you, am a practicing attorney. My practice is limited to estate and Medicaid planning. In running my own practice, I discovered how to run a successful business. Unfortunately, I had to learn the hard way, by trial and error. My practice was efficient; a secretary, a paralegal, and me, but I often became frustrated because I couldn’t “do everything.” My practice grew to the point where there was an 8-10 week wait to get an appointment with me and I was receiving 20-30 phone calls a day. Everyone told me I was successful and I believed it. I was making a lot of money, but something didn’t feel right. My time was no longer my own. My ability to be responsive to my clients and referral sources led to so much business, I could no longer be responsive. Many of the very people who referred clients to me began to get frustrated. I felt like a freight train heading for a wall.

Fortunately, the brakes locked up (on their own) before the wall came. My secretary, who did everything else, had a family emergency and was out of the office for 3 weeks. Production stopped dead. I didn’t even know how to get into my computer programs. It was a sign something had to change. Reality hit. What about next time? What if it were ME? What if I had an accident and was out longer? What would happen to my practice? My income? I became very uncomfortable, so I began to research my options. Just 3 years later, my firm has 3 attorneys, a paralegals, a marketing director, office manager and 5 support staff. During the same period, I tripled my revenue, and I leave the office for a month, annually, and come back to a bank account with more money than when I left. Now I take every other Friday off, travel one week a month to teach across the country and my practice continues to grow. I credit my growth to doing good, quality legal work that solves my clients’ problems and to creating a process that ensures all my clients receive the same quality work in a timely and consistent fashion, whether I or another attorney does the work.

Helping Others Profit From My Experience.
In early 2001, I was at a meeting of a national attorney organization to which I belonged, and was sharing my success with several other members. They were surprised because the downturn in the financial markets and the increasing federal estate tax exemption lead to a substantial decrease in their estate planning practices. Several asked how I was successful doing Medicaid planning. I shared my Medicaid planning success and my belief that the paradigms in estate planning continue to change, but people’s fear of losing their assets to a nursing home is constant. I also shared how enthusiasm among the financial advisors I worked with was high because I was able to provide “value add” to a vast majority of their clients. By the end of the conference, attorneys were stopping me in the halls to find out my “secret.” I agreed to teach them and Medicaid Practice Systems, LLC (MPS) was born. Since then, over 200 attorneys have taken my Medicaid Programs.

Clients Have No Protection.
Clients susceptible to being wiped out by nursing home costs far exceed those susceptible to being wiped out by estate taxes. America is aging. Baby boomers and other seniors are gravely concerned about catastrophic health care and losing their lifetime of assets. This trend is going to continue for the foreseeable future! Unlike Medicare, which is available to everyone over 65 and the disabled, Medicaid is only available if you meet the income and asset qualifying criteria. One of the greatest rewards in my practice is seeing the relief on my clients’ faces, when I design and implement an estate plan that provides for their families and ensures their assets will be protected if catastrophic illness occurs.

About The Program.
The MPS™ Medicaid Practice Program is a one year program which includes 6 days together that not only teaches you the federal and state legal-technical skills, but also teaches you how to implement the tools and process to run your office like a business. During the three 2-day sessions, you will learn the competence, gain the confidence and implement the process to ensure your success. We continue to support you with  monthly calls to catch you when you are falling (before you get hurt!) The Medicaid Practice Program™ was developed by experts in Medicaid planning, my office team. We also utilized outside experts in technology and communication and training skills to enhance our processes and systems for efficiency and enable us to consistently identify and satisfy our clients’ needs.

The Program is structured in two-day sessions that meet every two months. This enables us to teach you the law and our process in stages to build your confidence. During the six-days together, you will perform Medicaid calculations, qualifications, and do Medicaid planning for a vast number of actual client case studies. More importantly, you will understand the key issues to look for, the right questions to ask, and the right Medicaid laws and exceptions to apply. You will do everything in the program before doing it in your practice. We give you the tools, formulas, documents, creation system and systems necessary for your success. We also have an active listserv to support you in crisis. Our goal is to give you four years worth of experience in four months. For practicing estate planners, our goal is to increase your efficiency four times.

Who Should Take The Program?
This course is beneficial to transitioning lawyers (those moving from another area of the law to estate planning), new lawyers (those newly admitted who want to start their own profitable practice) experienced estate planners (who want to have a more efficient practice or add Medicaid planning) and law firms (who want to quickly develop a new profitable department). My new associates attend the program and I am able to get them profitable within three to four months. Medicaid planning is also a great area to get into if you are not feeling personal gratification in your current work. A recent graduate told me one of the greatest moments in his legal career occurred between sessions 1 & 2, when a client hugged him. A former litigator said he got the first hug from a client in his 23 years of practice. A high-net-worth estate planner told me he was amazed at the intellectual challenge of Medicaid Planning. Medicaid planning provides you the opportunity to charge a significant fee for your expertise, have clients thank you, gladly pay you, and it enables you to feel good about the work you do.
